tfp, from what has been discussed in the pepipoo forum this is not a new bit of legislation at all. dave isn't going down on the off chance that he'll get some answers. They officer has told him he will be more than willing to explain why to him if he wants to find out more which is a good attitude to have. marty, 54. (2) can be interpreted as the exhaust although not tampered with to make more noise has been replaced with one that does still make more noise. Under that it would come down to a judges opinion on how to read the law. Davemate, are you still going down tomorrow? If so good luck and I really hope we get some good answers.

Yep, I am just going to give them a call in the morning with heads up and ask to speak with an available person to ask some questions on the legislation, eg when checked that the car is louder than standard, how is it checked what the cars normal db level is plus about SVA/IVA rules being 101 (or 99 as it seems it now is) and about how this comes into force and finally I want to see in writing the guidelines on the 90db somewhere, or at least be pointed towards where this legislation is (as it seems unfair that this is not apparently written down, and therefore you can not know until you are prosecuted). All I want to do is go down and have a chat, as sad as it it, I do find it interesting and I also feel that it would be useful to the VX community to know an answer based on this constabulary so that others may consider this when modifying their cars.

off topic slightly... what happens if they say ok,go to our noise testing facilty and have a controlled test under test conditions(like they do when your car gets prohibited for anything until it can pass an mot).what happens if they have a new test facility and say you must now pass this if your contesting the ticket?would it pass?

Depends what level they set.If its 99db or 100db or whatever the sva test is then yes.if its motor sport level 98 then yes
if its standard factory then no and 75% of VX,s would be for track use only :lol:

if asked for noise again i would get the same value, I am sure. on other exhaust regs i do not know if it would pass, my friend that has an mot station said it was fine when it passed at his station.

Sad thing is, if you're right that the bit of kit cost £2000, and they're using it to hand out £30 fines, then they need to pull over and fine 67 people before the thing makes a profit. I know that the police say they don't fine people to turn a profit, but that still seems like yet another pointless shitty misguided use of money to me, to catch people who are at worst causing a bit of disturbance periodically.

Really??

So he's pulling over a lot of people for loud exhausts, and fining them? I don't see that many cars where you'd be suspicious of a loud exhaust.

As nice a guy as he may be sounds like he's taking the p*ss with these fines.

It's definitely not in their interests to try and prosecute an iffy case, because if their equipment/testing is proved to be inadequate then this would set a precedent and the "good" prosecutions i.e. the teenagers in Saxos doing doughnuts in residential areas at 10pm, would be thrown out on a technicality. It's worth trying to prove their case is weak, as it seems there is everything to gain and nothing to lose. However. if the police are confident I'll have to go the long way round when coming back from Snetterton. Recouping the £2k won't take more than a track day or two camped in Thetford.
