Selling An Unroadworthy Car To A Foreigner

Hi all, I have posted this on a couple of forums just to get an overall opinion - I have just recently sold the wifes Spitfire on Ebay, it was listed as having no MOT and needed a bit of working doing to get it back on the road. Anyway the car ended up going to a winning bidder in Germany! The problem I have is that he wants to collect the car and drive it back to DE, the car does drive but the brakes are a bit dodgy as its been laid up for a while, I did explain that it had no MOT(TUV) and it is illegal to drive, he says he can arrange some sort of trade insurance which covers him to drive the car, this may be legal in DE but I dont think it would cover him if he gets stopped by the police or stopped at customs. Once I get him to sign the V5 and a sales contract, should I worry about it or is it not my problem. Advice please, John.

John, Once youve signed it over to him, and you have the cash in your pocket, its no longer your responsibiliy. As you have also warned him that it is not roadworthy, and you clearly stated this in the advert, you should be covered against any comeback...... If you're really concerned about it, write out a declaration of sorts explaining the state of the car, and that he takes all responsibility for the car and get him to sign it before he departs....
