Have tried contacting steffen directly a few times now without success which I think is extremely rude on his part considering the patience I and others have shown, all I want to know is if we take the Robin option do we get a refund??? And if we decide to wait for the original when will we actually get it as previous manufacturing promises of 2/week have proven to be pie in the sky. I feel like sucker has been stamped to my forehead from this group buy and will certainly steer clear of any further foreign offerings. Steffen it may not be directly your fault but get some answers from whoever is producing the splitter so we can make an informed decision, I don,t think thats alot to ask considering all thats gone before.

Interested in going with Robin's option, but... only if we get a part refund considering the price difference... Without a refund I only see there an "occasion" for the producer to still make some money with our misfortune, which is a bit unfair considering the time he had got our treasury

I'm not the producer! I'don't have your money! I can't take decisions alone! So bevor I can give you an answer, i have to speak with the producer and that isn't easy also for me because he knows what i want in every phone call!. To make it short. In his point of few, Robin can make a better price because he doesn't have had the cost of developement. So his decision is no refund who takes the splitter from Robin.

I agree!

My question is now: Who wants the Splitter from Robin without any refund?

So the original producer (use the term loosely as he doesn't seem to have actually produced much) gets paid for failing to deliver a product? Wow.

Wow.

I think those who havent got the splitter yet need to have the full name and address of the maker so they can take any possible/necc steps to recover their money.

I have both and Robins splitter is nothing like the group buy one, it fits differently, its lighter, its a totally different shape underneath, the front contour is different. The "developement" Robin may have borrowed is marginal if at all.

And also worth mentioning is he dosnt have to paint them so again he saves some money. Steffan i know you dont have the money but can you honeasly say that people are being ripped off by a producer that has not provided a item which was ment to be dilivered in january not six months later Ive asked you to ask the maker for a sensible refund on ones left in uk buy as he dosnt have postage costs nor painting cost etc to cover which i do not feel is a unresoable ask. I dont mind making them for uk or german group buy but do everyone a favour and knock the makers head against a wall and get this finalized once and for all as it really is stupid how slow you And the maker have been to finalize this when i made the offer to you some time back to help finnish the production run. Ive put this on here as you dont reply to messages!

After a "reasonable" time I would imagine if it hasnt arrived it could be taken that it isnt going to so I dont think distance selling comes into it, its more like failing to fulfill a contract. I'm certain distance selling act only applies to rejection of goods within 7 days of receipt anyway and I'm not sure it works across borders anyway.

Doubt very much that it covers "private" arrangements like a Group-buy and not sure it would apply to an overseas transaction anyway. Whoever this producer is, should just refund the money for all outstanding splitters in full. The producer has presumably already offset his development costs in the pricing of the initial German forum group-buy (as at that time he had no expectation of selling an additional batch to UK owners). To get Robin to supply his splitter (which is excellent BTW) in place of what was originally ordered and to then still make €100+ per non-supplied splitter is disgraceful behaviour. Robin's splitter is a totally different design and I'm sure Robin had his own development costs, he's just more realistic about what those costs are and has the ability to actually supply them within a proper timeframe. T'is a fecking mess and I'm glad I baled out at an earlier stage before I'd made payment. ETA: Too slow. Should have pressed send 10 minutes ago instead of making a coffee.

Steffen I purchased the splitter in all good faith on your recommendation of 'YOUR GROUP BUY'............... In your enthusiasm, you published photos of splitter and actively advertised this product.... You have a responsibility to sort this out this farce. We have all been extremely patient with the time delays (excuses) and the fact our money has been sitting in the producers bank account for over six months. It would be interesting to know the number of splitters outstanding??????????? And now to offer an alternative supplier whose product is a considerable lower price and no refund is ucking disgraceful. Insult to injury keeping the Postage costs as well 1 X Splitter: €295.- + €45.- = €340.- for the PAYPAL PAYMENT +4% = €353,60 Production costs bullshit, how many have be supplied to date....and is your producer still in production????????? This Group Ripoff goes from bad to worst... Maybe they will be in time for the VX International Meeting in 2012..... Unfortunately your are the face and owner of this Group buy.....

Some useful info in here regarding the Mahnverfahren, which is the German version of the small claims court. Not sure how viable it is to start any kind of proceedings but may be worth researching the options.

Just get an address of the supplier, also steffan do you have a receipt for monies paid to the supplier? List here the forum names of those in the GB buy who have paid and not gotten splitter. Who know what could happen if this info was listed here........ ;)
